OK so heres the deal.A few years back my dad purchased a 1953 chevy pickup.It was completely restored to a show winning truck.The problem was that he used money that was specifically saved for me and my 16 year old brother to go to college.Well now my parents are getting a divorce.heres where my problem lies…The cars original title had stated that me,OR my brother,Or my dad were the owners of the vehicle.After hearing about the divorce between my parents I had the title(aka the pink slip) changed into my name legally.well before i could get the new pink slip in the mail and sell it he took it from my garage while i was sleeping.I filed a police report but they dropped it as a stolen vehicle saying its up to the courts.What should i do to get this truck back???
p.s. his argument is that he has the car currently registered in his name.my counter argument is that I have the pink slip in my name only and obtained it legally.
1. Whose name was on the title until you changed it?
2. How did you "legally" obtain this vehicle since it was not in your name ( you state you had it changed into your name)?
3. Your statement says it was in your name, dad or your brother. Do you feel that YOU should have it over your brother or that you were just sneakier by falsifying a bill of sale to get it in your name first, hence you are the "legal" owner?
4. Was the savings account for the college education a true savings account or a legal trust fund? If this was just savings, then Dad made a decision to spend it as an investment buying this truck.
5. Who notorized a title's false signature? Who signed the legal owner's signature on the title" You stated you changed it into your name, so it couldnt have been there originally.
6. Your closing statement is that you have a pink slip in your name legally. Please describe the legal method used to place the title in YOUR name only.
7. If this does go to court, as you are describing the actions taken, it sounds as though you commited grand theft auto. Consult an attorney to see where you legally stand from the actions you have taken here.
